Utah House Passes E-Verify Bill
On March 11, 2010, the Utah House passed SB251, a bill that requires private employers with 15 or more employees to register with and use a status verification system to verify the federal legal working status of any new employees. The bill, passed by a 46-24 margin, awaits Governor Gary Herbert’s signature.
If the bill is signed, private employers in Utah with more than 15 employees will be required to use the federal E-Verify program beginning July 1, 2010. Utah public employers and those who contract with the state have been required to use E-Verify since July 1, 2009.
Additionally, beginning in July, the state Department of Commerce will begin publishing a list of businesses participating in E-Verify. Any Utah employer using E-Verify can voluntarily register to be included on the Department of Commerce’s list.
E-Verify is a federal program that employers use to check the work status of new hires electronically by comparing information from an employee's Form 1-9 against the E-Verify Social Security Administration and Department of Homeland Security databases. Under federal law certain federal contractors are required to participate in the E-Verify program. Additionally, several states have enacted their own E-Verify legislation requiring certain employers to participate in the program.
