E-Verify Effective Date for Federal Contractors Extended to May 21, 2009

The effective date for the rule requiring federal contractors to use the E-Verify program has been extended May 21, 2009, a formal notice announcing the delayed implementation is expected to be published in the Federal Register on Friday, Jan. 30, 2009.

The original effective date of Jan. 15, 2009 for mandated federal contractor participation in E-Verify was extended to February 20, 2009 by the US Department of Justice when the US Chamber of Commerce, SHRM, and two other organizations filed suit in federal court. In the suit the parties have challenged the executive branch’s authority to mandate the program, requesting the regulation be set aside.

The second extension comes on the heels of a memo issued by the Obama Administration which asked federal agencies and departments to consider extending the effective date of any regulations which had not yet taken effect so the new administration could have an opportunity review them.
